Petow notes that many disabled people have difficulty articulating how their disabilities impact their lives. She recommends that disabled claimants enlist the support of a “personal advocate” as well as an attorney or non-attorney representative.

Petow argues that properly completed Social Security forms can serve as a low cost “day in the life video.”

If Social Security forms were not completed in detail as the book recommends, the missing detail can be filled in during the claimant’s hearing testimony. Proper preparation for the hearing level would require that the representative be familiar with the content of all the forms already filed. See 1996 SSR LEXIS 4, 15-16, SSR 96-7p, on the adjudicator’s affirmative duty to compare the claimant’s statements.

As noted in Chapter 7, much of the testimony at the hearing level will be answering questions similar to Questions 5 and 6 on Form 3373.

Chapter 1 of the book is entitled, “You Need a Representative.” This chapter discusses sequential evaluation, residual functional capacity and medical-vocational rules. Over 25 issues are listed as ones for which a representative is needed and for which a representative should be prepared.
